"NOX – THE SOCIAL ALARM CLOCK"

PREAMBLE

These "Terms of Use" constitute the main contractual document governing access to and use of the "NOX – The Social Alarm Clock" application (hereinafter "NOX"), published by the company LAPSUS, registered in France.

They set out the reciprocal rights and obligations of the Publisher and the users of the application, whether they are simple visitors or account holders. They are part of a structured contractual whole, made up of complementary documents, each with a specific legal function.

Acceptance of the "Terms of Use" implies the acceptance of this entire contractual ecosystem, the components of which are as follows:

  • " Legal Notices" :
    Provides the required information about the Publisher, the host, the editorial responsibility and the applicable legal bases;
  • "Terms of Use" :
    Define the rules applicable to access, browsing, using the features and publishing content on the application.
  • " General Sales Conditions" :
    set out the contractual terms and conditions related to the "NOX Premium" subscription, including price, invoicing, renewal and termination.
  • "Privacy Policy" :
    Details the processing of personal data carried out by the Publisher, the applicable legal bases, and the rights of users.
  • "Data Collection Policy" :
    Write down the technologies used to collect technical and behavioral data, as well as the associated preferences.
  • "Illicit Content Reporting and Removal Policy" :
    Regulates the procedure allowing users or third parties to alert the Publisher to the presence of illegal content and to request its removal.
  • "Child Safety Policy" :
    Refers to the specific rules applicable to minors, protection parameters, access bans and alert procedures.
  • "Copyright and Intellectual Property Policy" :
    Establishes the rules applicable to protected content, original creations, fair use and respect for the rights of third parties.
  • "Advertising and Sponsored Content Policy" :
    Governs the distribution of advertising and sponsored content, whether generated by the Publisher or by users.
  • "Moderation Policy" :
    Sets out the principles of content moderation, the methods used, the priorities for action and the applicable sanctions scales.
  • "List of Prohibited Content" :
    Explicitly and in detail identifies content prohibited on the platform, regardless of its public or private status.
  • "Code of Conduct" :
    Recalls the core values and expected behaviors within the NOX community.
  • "Legal Provisions for the Attention of the Authorities" :
    Groups together the information and communication procedures intended for judicial, administrative or law enforcement authorities.

Each of these documents can be freely consulted from the application or via the dedicated portal at the following address: https://www.nox.app/legal. Together, they form the legal basis applicable to all uses of the application.

The Publisher invites each user to read all these documents carefully before any use. By accessing the application, the user acknowledges that he or she has read the "Terms of Use" and undertakes to comply with all the rules resulting from them.

The User is invited to regularly consult these "Terms of Use", available at any time from the "Legal information" sub-menu of the "Settings" menu of the Application or via the website dedicated to NOX's legal information: https://www.nox.app/legal.

USERS ARE STRONGLY ADVISED TO READ THESE "TERMS AND CONDITIONS OF USE" CAREFULLY BEFORE USING "NOX".

INTRODUCTION

"NOX – The Social Alarm Clock" is an innovative social network based on the new concept of the personalized alarm clock. The Application allows its Users to create, send, receive and watch short videos – called "nox" – intended to wake up in a fun and interactive way. The principle of NOX is to create a new global and intergenerational space of creation and expression transforming the moment of awakening into a social and entertaining experience.

NOX exists only in the form of a mobile application designed, created, developed and published by the French company LAPSUS, a simplified joint-stock company with a capital of €12,000, whose registered office is located at 10 rue Louis Amiot, 01000 Bourg-en-Bresse, registered with the Bourg-en-Bresse Trade and Companies Register under number 879 161 818, and represented by Mr. Luc NOUGUIER, President of LAPSUS (hereinafter "the Publisher").

The NOX app is available for download worldwide since Monday, April 14, 2025 on the following platforms:

The purpose of these "Terms of Use" is to define the rules governing the use of the "NOX – The Social Alarm Clock" application, as well as the rights and obligations of the people who access, browse, register, publish content or use one of its features.

This document constitutes the main contractual framework between the user and the Publisher. It sets the conditions under which the application can be used, specifies the respective responsibilities of the parties, and regulates the authorized or prohibited behaviors on the platform.

The "Terms of Use" address in particular:

  • the terms and conditions of access to the application and the conditions of registration;
  • the rules applicable to user accounts, their creation, management and possible deletion;
  • obligations to behave and respect others within the application;
  • the types of content that can be published and the responsibilities related to its distribution;
  • restrictions on "Sensitive Content" or "Prohibited Content", as well as reporting and moderation mechanisms;
  • the consequences that may result from non-compliance with the established rules, including sanctions and measures of suspension or termination of accounts;
  • the security and privacy principles relating to the use of the application.

1. DEFINITIONS

For the purposes of this "Terms of Use", the following terms shall have the following meanings, whether used in the singular or plural:

Contractual Terms: refers to all legal documents applicable to the use of the Application, including the Legal Notices, Terms of Use, General Sales Conditions, Privacy Policy, Data Collection Policy, Illicit Content Reporting and Removal Policy, the Child Safety Policy, the Copyright and Intellectual Property Policy, the Advertising and Sponsored Content Policy, theModeration Policy,List of Prohibited Content, Code of Conduct, and Legal Provisions for the Attention of the Authorities.

Application: refers to the mobile application "NOX – The Social Alarm Clock," created, developed, and published by the Publisher. The Application is intended to be downloaded and installed on a compatible Device (smartphone or tablet), and allows the use of features offered by the Publisher, such as the creation and reading of "noxs." Subject to compliance with the "Terms of Use" and Legal Notices and any technical requirements, the Application is available on the following download platforms: Apple’s "App Store," Google’s "Play Store," Amazon’s "Amazon Appstore," Samsung’s "Galaxy Store," Huawei Technologies' "Huawei AppGallery," Xiaomi's "Xiaomi Get Apps," Oppo’s "Oppo App Market," AppGallery," Xiaomi's "Xiaomi Get Apps," Oppo’s "Oppo App Market," Vivo's "V-Appstore," Tencent’s "Tencent Appstore," Xiaomi’s "Mi Store App," Aptoide S.A’s "Aptoide," "APKPure." Access to and updates of the Application, as well as any geographical or technical restrictions, may vary depending on the app stores and the applicable policies.

Publisher: refers to the French company LAPSUS, a simplified joint-stock company (SAS) registered with the Bourg-en-Bresse Trade and Companies Register under number 879 161 818, with its registered office located at 10 rue Louis Amiot, Bourg-en-Bresse. The Publisher is legally responsible for the brand and the "NOX – The Social Alarm Clock" Application. The Publisher is responsible for the design, development, publishing, and Publisher is responsible for the design, development, publishing, and availability of the Application, as well as all associated Services. It is also responsible for publishing and maintaining the technical aspects of the Application, including any updates or new features offered to Users.

User: refers to any individual who accesses and uses the Application for private or professional purposes. The User may be a non-professional individual, a consumer as defined by the Consumer Code, or any other person using the Publisher's services. The User may therefore enter into an agreement with the Publisher to acquire content or use features available on the Application, under the conditions defined by the "Terms of Use" of the Application.

Minor: refers to any person under the age of 15. This age corresponds to the minimum required to register on the Application, as set by the Publisher in accordance with applicable legislation, particularly concerning the protection of minors and digital consent, as well as the "Child Safety Policy".

Child: refers to any minor within the scope of the "Child Safety Policy", including those who have accessed the Application in violation of the registration conditions. The rules stated here aim to ensure the safety of children under all circumstances, including in cases of unauthorized or fraudulent access.

Parties: refers collectively to the Publisher of the Application and the User, bound by the acceptance of the applicable contractual documents, including the "Terms of Use", "General Sales Conditions", and "Legal Notices". The Parties acknowledge their mutual commitments, respective responsibilities, and the legal rules governing their relationship in the context of using the Services offered through the Application.

Device: refers to any hardware used by the User to access the Application, download, install, and use its features. This includes, but is not limited to, smartphones, tablets, laptops or desktop computers, and compatible connected objects. The Device must meet the minimum technical requirements set by the Publisher, including operating system, available memory, performance, and connectivity. The User is solely responsible for installing the Application on their own Device, ensuring its compatibility, proper functioning, and security of their digital environment, including regular system updates, the use of antivirus digital environment, including regular system updates, the use of antivirus software, and protection against malware.

Download Platform or Store: refers to any third-party service that allows downloading or updating the Application, such as Apple’s "App Store," Google’s "Play Store," Amazon’s "Amazon Appstore," Samsung’s "Galaxy Store," Huawei Technologies' "Huawei AppGallery," Xiaomi's "Xiaomi Get Apps," Oppo’s "Oppo App Market," Vivo's "V-Appstore," Tencent’s "Tencent Appstore," Xiaomi’s "Mi Store App," Aptoide S.A’s "Aptoide," "APKPure." Appstore," Xiaomi’s "Mi Store App," Aptoide S.A’s "Aptoide," "APKPure." Access to these platforms is subject to the general terms and conditions of each provider, over which the Publisher has no control.

Service: refers to all the features and services offered by the Publisher via the Application, including but not limited to:

  • Creation, publishing, sending, and reading of "noxs";
  • Programming and triggering alarms to automatically play one or more "nox(s)";
  • Creation, publishing, sending, and reading of "dreams";
  • Management of a personal profile;
  • Visiting other Users' personal profiles;
  • Textual, visual, and voice communication with Users via messaging;
  • Access to subscription plans such as "NOX Premium", which provides additional features or benefits;
  • Any other service or content that the Publisher decides to make available to the User, subject to compliance with the "Terms of Use", "Legal Notices", and applicable laws.

The Service is subject to change or enhancement over time, including through updates, fixes, interface modifications, or the addition of new offers, whether free or paid, without creating any obligation for the Publisher beyond what is specified herein or in specific conditions.

Host: refers to the technical service provider responsible for ensuring the storage, accessibility, and operational maintenance of the Application and its digital content. The Host acts as a technical intermediary in accordance with applicable legislation (notably the LCEN and DSA), without intervening in the hosted content. The Host’s contact information is provided in the "Legal Notices", "Terms of Use", and "Privacy Policy", in accordance with the identification requirements imposed on the Publisher.

User Account: refers to the personal space of each User, accessible after a registration or login process via an identifier (email address, phone number, etc.) and a strictly confidential password. From this space, the User can, among other things:

  • Add or modify their profile picture;
  • Add or modify up to ten cover photos;
  • Add or modify their profile description;
  • Add content to their profile ("noxs," "renoxs," dream collection);
  • Modify the thumbnails of their created "noxs";
  • Pin created "noxs";
  • Pin "renoxs";
  • Delete content from their profile ("noxs," "renoxs," dream collection);
  • Access their list of received notifications;
  • Manage their subscription list;
  • Access their list of followers;
  • Manage their list of friends;
  • Modify their name;
  • Modify their username;
  • Modify the email address for accessing their account;
  • Modify the phone number for accessing their account;
  • Modify the password for accessing their account;
  • Send a request for personal data transmission;
  • Subscribe to or unsubscribe from the paid service "NOX Premium";
  • Send a request for account certification;
  • Manage privacy settings;
  • Access their liked "noxs";
  • Access their viewed "noxs";
  • Access the archives of created "dreams";
  • Access the archives of created "noxs";
  • Modify the application language;
  • Modify the application appearance;
  • Manage blocked Users;
  • Manage sensitive content settings;
  • Access the Application's user guide;
  • Access the legal information of the Application;
  • Access the social media of the Application and the Publisher;
  • Delete their account.

The User Account is personal, non-transferable, and protected by confidential identifiers whose security is the sole responsibility of the User. The User commits to immediately inform the Publisher of any suspicion of fraudulent access or compromise of their account and to comply with the applicable "Terms of Use".

Evolving Features: refers to any new feature, tool, or service added later to the Application, whether experimental, promotional, or permanent, subject to the "Terms of Use" and applicable rights.

Social Features: refers to the tools for interaction between Users within the Application, such as messaging, comments, subscriptions, "likes," shares, and any communication, visibility, or community relationship feature integrated by the Publisher.

Inappropriate Behavior: refers to any behavior or interaction, direct or indirect, contrary to the spirit of the "Code of Conduct", which may harm the well-being of other Users or compromise the overall atmosphere of the Application.

Content: refers to any type of digital content accessible, published, or distributed via the Application, including texts, images, videos, sounds, data, or any other element. Content includes, but is not limited to:

  • The "noxs" created by Users, intended for other Users or for their own use, which are videos of a maximum duration of two minutes, intended to wake Users of the Application;
  • The thumbnails of "noxs," which are images serving as covers for a "nox." They represent the content of the "nox" and are designed to capture attention at first glance in the Application;
  • The "dreams" created by Users, which are photos or videos of a maximum duration of two minutes, intended to stay online in the Application for only 24 hours. "Dreams" allow the User to communicate daily with the community of Users who follow them in the Application;
  • Collections of "dreams," which are groups of "dreams" organized into folders, directly accessible from the Users' profiles. Each collection is visually represented by a cover image, designed to evocatively illustrate the theme or common universe of the "dreams" it contains;
  • Profile photos;
  • Cover photos;
  • Profile text descriptions;
  • Comments posted in the comment section of a "nox";
  • Text messages exchanged in messaging conversations;
  • Photos exchanged in messaging conversations;
  • Videos exchanged in messaging conversations;
  • Voice messages exchanged in messaging conversations;
  • GIFs exchanged in messaging conversations;
  • Any file or information made available by the Publisher or third parties on the Application, provided it complies with copyright, the "Terms of Use", and applicable legislation.

The User declares and guarantees that they hold all the necessary rights for the publication, distribution, or availability of any Content via the Application, including copyright, image rights, or any other intellectual property rights. They agree to hold harmless and indemnify the Publisher against any claim, action, or damage resulting from a violation of applicable law or third-party rights.

Public Content: refers to any content visible to other Users beyond the creator, including public "noxs," public "dreams," comments, dream collections, or profile elements.

Private Content: refers to any content accessible only to one or more designated Users, such as private "noxs," private "dreams," or private messages.

Classic Content: refers to any content published on the Application that is neither sponsored, sensitive, nor prohibited. It may be public or private, depending on the settings chosen by the User at the time of publication, and remains subject to the present "Terms of Use" and the "Code of Conduct". Classic Content is the standard, unmarked form of content on the Application and carries no special labeling at the time of distribution.

Organic Content: refers to any content spontaneously published by a User or, where applicable, by the Publisher, without financial compensation, promotional intent, or any link to an advertising campaign, communication effort, or commercial partnership. Organic Content does not carry any commercial or promotional tag and is not subject to specific monetization-related processing. It may be public or private depending on the chosen publication settings and remains subject to the "Terms of Use" and the "Code of Conduct".

Sponsored Content: refers to any "nox" or "dream" published by a User on the Application with the "Sponsored Content" tag, activated at the time of publication to indicate that the content is shared for promotional or advertising purposes.This tag is mandatory whenever the content is published in exchange for financial gain, material benefit, or a visibility agreement with a third party, including the Publisher. It ensures transparency toward other Users and automatically displays the visible mention “Sponsored Content” when the content is played or opened.
The use of this tag, as well as the obligations associated with it, are defined in the "Advertising and Sponsored Content Policy", which all Users are contractually bound to.
Sponsored Content is distinct from commercial advertisements shown within the Application and content published as part of a Paid Partnership managed by the Publisher.

Prohibited Content: refers to any content, regardless of format or medium, that violates the "List of Prohibited Content", contravenes the contractual rules applicable to the Application (such as the "Terms of Use", the "Code of Conduct", or the "Moderation Policy"), or breaches applicable laws and regulations, particularly those concerning the protection of minors, public safety, fundamental rights, and intellectual property.
"Prohibited Content" triggers immediate moderation measures, contractual sanctions, or reports to the competent authorities, without the need for prior warning.

Sensitive Content: refers to any content published on the Application with the "Sensitive Content" tag, activated by the User at the time of publication due to its potentially shocking, disturbing, violent, sexual, or emotionally difficult nature. This tag is mandatory for such content to be tolerated on the Application. It is intended to restrict access, warn viewers, and protect Users—especially minors. Content that may offend sensitivities but is tolerated under certain conditions is defined in the "List of Prohibited Content". If published without the "Sensitive Content" tag, such content will be considered non-compliant and may be subject to moderation measures, including permanent and irreversible removal.

Sensitive Content Management Setting: refers to the system integrated into the Application that allows for the display or blocking of sensitive content based on the User’s age and declared preferences. This setting is automatic and non-editable for minors and customizable for adult Users.

Nox: refers to a video with a maximum duration of two minutes, primarily designed to wake a User of the Application in a fun and interactive way.

Renox: refers to a "nox" — a video of no more than two minutes designed to wake a User in a fun and interactive way — that has been republished by a User on their own profile.

Dream: refers to a photo or video that disappears after 24 hours, used to communicate with one’s community of Users.

Alarm: refers to the feature of the Application that allows the User to schedule or receive a "nox" at a specific time, for a personalized, social, and interactive wake-up experience.

Messaging: refers to the communication system integrated into the Application, allowing Users to exchange text messages, voice messages, photos, GIFs, and other files, either in private or group conversations.

Notification: refers to any message or alert sent to the User via the Application or through an external channel (push notification, email, etc.), for the purpose of providing information, reminders, security alerts, or promotional content, in accordance with the User’s communication preferences.

Subscription: refers to a contract concluded between the User and the Publisher, involving the payment of a fee in exchange for prolonged access to certain features, services, or exclusive content on the Application, for a fixed or renewable period.

NOX Premium: refers to the paid monthly subscription plan offered by the Publisher, providing the User with an enhanced experience of the Application, including the removal of unsolicited ads, advanced features, customization options, and exclusive benefits. Sponsored content and paid partnerships remain visible. The details and terms of the offer are defined in the "Terms of Use" and the "General Sales Conditions".

Personal Data or Personal Information: as defined by the General Data Protection Regulation (GDPR – EU 2016/679) and any equivalent or complementary national legislation, refers to any information relating to an identified or identifiable natural person. An “identifiable natural person” is one who can be recognized, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or to one or more specific elements related to their physical, physiological, genetic, psychological, economic, cultural, or social identity.

The processing of such Personal Data, carried out as part of the use of the Application and associated Services, is governed by the “Publisher's Privacy Policy”, available at https://www.nox.app/legal/privacy-policy.
The Publisher undertakes to comply with all applicable regulations concerning the protection of personal data, privacy, and the rights of data subjects.

Consent: refers to the free, informed, specific, and unambiguous expression by which the User agrees, through a clear affirmative action or declaration, to the processing of their personal data for one or more specific purposes.When data is collected through trackers, consent must be obtained before any placement or activation of non-essential trackers, in accordance with applicable regulations and the "Data Collection Policy". Consent can be withdrawn at any time via the Application's settings, without retroactive effect.

Privacy Settings: refers to all options available within the Application that allow the User to personalize how their personal data is managed, how visible their content is, or how exposed they are to certain types of sensitive content.

Data Collection:Data Collection: refers to any operation carried out by the Publisher, its third-party partners, or subcontractors involving the collection of personal or non-personal data related to Users of NOX. This may occur actively (e.g., through user input) or passively (e.g., through trackers or Application features), to ensure the proper functioning, continuous improvement, security, and personalization of the provided services. Data collected may include registration data, published or viewed content, user-defined preferences, technical data related to browsing or Application usage.

Browsing Data: refers to information automatically collected during the use of the Application, related to how the User accesses, uses, and interacts with features or content. This data may include, but is not limited to, the type and model of the Device used, operating system, interface language, session durations pages or content viewed, actions performed, errors encountered, technical performance or log data.
Browsing Data may be used for technical, statistical, analytical, or personalization purposes, in accordance with the "Data Collection Policy".

Advertising Network: refers to any entity, internal or external to the Publisher, responsible for the delivery, management, optimization, or performance measurement of advertising content distributed within the Application. Advertising Networks may use technologies such as trackers, SDKs, or advertising identifiers to adapt, target, or analyze ads. They may act on behalf of the Publisher or third parties, under the terms defined by the "Data Collection Policy" and the "Advertising and Sponsored Content Policy".

Third-Party Partner: refers to any external service provider, technology vendor, or collaborator with whom the Publisher works for the functioning, analysis, optimization, or monetization of the Application, and who may, in that capacity, collect, receive, process, or access User-related data.This includes, in particular partners involved in the deployment or activation of trackers (e.g., Google Ads, Firebase Analytics), those responsible for hosting, audience measurement, performance management, ad distribution, security, or data analysis. The terms governing the relationship between the Publisher and each Third-Party Partner are outlined in the "Data Collection Policy".

Processing: refers to any operation or set of operations performed on Personal Data, such as collection, recording, organization, structuring, storage, adaptation, modification, retrieval, consultation, use, disclosure, restriction, deletion, or destruction.

Tracker: refers to any technological device that enables the reading, writing, or collection of information on the User’s Device, either directly or indirectly, from the Application. This includes, but is not limited to cookies, SDKs, web beacons, tags, advertising identifiers (e.g., IDFA, GAID), or any similar mechanism.Trackers may be used for technical, functional, statistical, audience measurement, or advertising purposes, and may require prior User consent depending on their nature, in accordance with the "Data Collection Policy" and applicable regulations.

Essential Functional Trackers: refers to tracking technologies strictly necessary for the technical functioning of the Application or the provision of a service expressly requested by the User. These trackers do not require prior User consent, as they help ensure service security, session management, content synchronization, alarm triggering, proper functioning of essential Application settings.Their use is governed by the "Data Collection Policy" and complies with applicable legal requirements regarding privacy.

Consent-Based Trackers: refers to trackers or similar technologies used for non-essential purposes, including advertising, statistics, personalization, audience measurement, or profiling, which require the User’s free, informed, specific, and unambiguous consent. Consent must be obtained before any data is stored or read on the Device, either during Application installation or via Privacy Settings. The User may withdraw consent at any time, without retroactive effect, in accordance with the "Data Collection Policy".

SDK (Software Development Kit): refers to a third-party software module integrated into the Application, enabling the addition of technical features, interfacing with external services, or collecting behavioral data about Users. SDKs may be used for audience analysis, performance measurement, marketing attribution ad management security, authentication. Some SDKs may include consent-based trackers, especially when they access advertising identifiers or perform profiling. Their use is governed by the "Data Collection Policy".

Tag: refers to a piece of code embedded in the Application, used to trigger a tracking event or record a user interaction, typically for measurement, targeting, or marketing performance purposes. A tag may be used, for example, to track an impression or click, trigger a conversion in an ad campaign, transmit data to an analytics tool or advertising network.

Tracking Pixel or Spy Pixel: refers to a snippet of code or invisible image (usually 1x1 pixel in size) embedded in the Application interface, enabling the tracking of content display, loading, or interaction by the User for analytics, audience measurement, or advertising performance purposes. These pixels may transmit information to third-party tools or advertising networks, particularly for retargeting or conversion campaigns, and are subject to the User's prior consent when involving the processing of personal data.

Advertising Identifier: refers to a unique, resettable identifier assigned by the operating system of the Device (e.g., IDFA on iOS or GAID on Android), allowing the tracking of the User’s advertising preferences and the delivery of personalized or targeted ads. This identifier may be used by the Publisher or third-party partners for performance measurement, retargeting, or behavioral analysis. Its use is subject to the User’s prior consent, in accordance with the "Data Collection Policy" and applicable privacy regulations.

Advertisement: refers to any content displayed within the Application for promotional or commercial purposes, intended to promote a product, service, brand, or entity. Advertising may be delivered by the Publisher, third-party advertising networks, or Users in the context of sponsored content, and may take various forms (banners, interstitials, videos, tagged organic posts, etc.). It is distinct from editorial or personal content by its commercial purpose.

External Advertising: refers to any form of advertising inserted into the Application via a third-party advertising network, such as Google Ads. It may be automatically displayed in the interface (banners, interstitials, videos, etc.), based on distribution settings defined by the network and the User’s preferences. The display of External Advertising is subject to the User’s consent, especially when it involves trackers or advertising identifiers (IDFA, GAID).

Internal Advertising: refers to any advertisement displayed within the Application by the Publisher, either directly or via its own advertising system. It may promote the Publisher’s services, content, or offers, or those of selected partners within the context of promotional agreements. Internal Advertising may appear as visuals, videos, suggestions, notifications, or dedicated placements within the interface. Targeted Advertising: refers to any form of advertisement personalized based on the User’s data, such as browsing behavior, profile, interactions, or preferences. It may be delivered by a third-party network (as part of External Advertising) or by the Publisher (as part of Internal Advertising), subject to the User’s prior consent in accordance with applicable regulations. Activating Targeted Advertising involves the use of advertising identifiers or trackers for profiling purposes.

Paid Partnership: refers to any agreement between the Publisher and a third-party entity resulting in the display of promotional or advertising content within the Application. These contents are published directly by the Publisher in an organic format and are clearly labeled as “Paid Partnership.”This type of content is the sole responsibility of the Publisher and is distinct from Sponsored Content (published by Users) and advertisements delivered by internal or external ad networks. The terms applicable to Paid Partnerships are defined in the "Advertising and Sponsored Content Policy".

Creator: refers to a User who publishes original or creative content on the Application, for which they are either the author or the holder of the necessary distribution rights. The Creator is responsible for ensuring compliance with applicable intellectual property rights and agrees to only publish content that complies with the contractual rules of the Application.

Protected Work: refers to any original intellectual creation expressed in a perceptible form and meeting the conditions for protection under the French Intellectual Property Code. This includes, but is not limited to, literary, artistic, musical, audiovisual, graphic, visual, photographic, software, digital, or multimedia creations.

Intellectual Property: refers to all exclusive rights granted by law to individuals or legal entities over their intellectual, artistic, technical, or commercial creations. This includes copyright and related rights of performers, producers, and publishers; rights over databases; and industrial property rights such as trademarks, designs, models, and patents. These rights give their holders control over the use, reproduction, performance, or distribution of their works, creations, or distinctive signs, in accordance with the provisions of the Intellectual Property Code and applicable international agreements.

License of Use: refers to the authorization granted by a rights holder, allowing the Publisher or a User to use a protected work or content within the limits defined by the agreed conditions. The license may cover various rights (reproduction, representation, adaptation, etc.) and specify the duration, geographic scope, authorized uses, and any applicable restrictions. It does not transfer intellectual property but provides a legal framework for lawful exploitation under applicable provisions.

Licensed Content: refers to music, works, or protected elements made available by the Publisher within the Application, for which a valid license has been obtained. This license allows, under the conditions defined by the Publisher, Users to incorporate such content into their own creations published on the Application. The use of Licensed Content remains subject to compliance with associated rights, any limitations set out in the license, and applicable contractual rules.

Infringement: refers to any use, reproduction, performance, distribution, modification, or adaptation of a protected work without the prior authorization of the rights holder, constituting a violation of their intellectual property rights. Infringement may apply to literary, artistic, musical, audiovisual, software, or any other protected content and may result in civil and criminal liability in accordance with the Intellectual Property Code and applicable laws.

Third Party: refers to any individual or legal entity not party to the contractual relationship between the Publisher and the User, and who is neither acting as the Publisher nor as a User of the Application. A Third Party may, for instance, be a rights holder of published content or be affected by a creation, publication, data processing, or use within the Application without directly participating in it.

Moderation: refers to all actions carried out by the Publisher’s dedicated human moderation team to monitor, assess, classify, process, restrict, or remove content or behavior reported or identified as contrary to the Application’s contractual rules, the law, or the ethical standards defined by the Publisher. Moderation may be reactive (following a report) or proactive (based on internal checks), and aims to ensure a compliant, safe, and respectful environment for all Users.

Report: refers to the feature available to Users that allows them to notify the Publisher, via the Application, of any content, behavior, or profile potentially violating the present contractual policies, applicable laws, or the rights or safety of an individual— particularly a child. A report may trigger a priority review by the human moderation team, in accordance with procedures outlined in the "Moderation Policy" and the "Child Safety Policy".

Report Category: refers to the descriptive category selected by the User when submitting a report, used to classify the presumed nature of the violation (e.g., hate speech, harassment, identity theft, inappropriate content, child endangerment, etc.). The Report Category guides how the moderation team processes the report and may, in some cases, automatically trigger the display of specific forms adapted to the severity or nature of the content in question.

Content Author: refers to the User who originally published, shared, or made content available on the Application, including content that becomes the subject of a report. The Content Author is legally responsible for complying with contractual rules, applicable rights, and legal obligations related to that content.

Complainant: refers to the User who initiated a report by notifying the Publisher of content, behavior, or a profile they believe violates the contractual rules or violates the contractual rules or applicable law. The identity of the Complainant remains strictly confidential and is never disclosed to the Content Author, unless required by law or judicial order.

Sanction: refers to any action taken by the Publisher against content, behavior, or a User that violates the contractual rules, current legislation, or the standards defined by the Publisher. Sanctions may include, but are not limited to: reclassification or removal of content; temporary or permanent restriction of functionalities, suspension or deletion of the user’s account, reporting to competent authorities in the case of serious misconduct or suspected criminal offense. The application of sanctions is at the sole discretion of the Publisher, in accordance with its "Moderation Policy".

Competent Authorities: refers to all judicial, administrative, law enforcement, or institutional authorities legally empowered to receive, process, or request information, reports, or evidence related to the protection of minors, the prevention of criminal acts, the fight against illicit content, and the suppression of dangerous behavior. This includes, but is not limited to, police or gendarmerie services, judicial authorities, independent authorities (such as regulatory agencies), any entity legally designated for this purpose under applicable law.

Legal Notices: refers to the document prepared in accordance with current French and European legislation intended to inform the User of key aspects related to the use of the service. It outlines the identification details of the Publisher, hosting information, intellectual property rights, data processing terms, and legal responsibilities of both the User and the Publisher, particularly under the French Law for Confidence in the Digital Economy (LCEN), the General Data Protection Regulation (GDPR), and the Digital Services Act (DSA). The creation of a "User Account" is essential to access all the interactive features offered by NOX, including the use of the alarm clock, the reading of noxs or the creation of noxs. However, it should be mentioned that a video stream gathering the most popular noxs of all time is accessible when opening the application for non-registered or non-logged in users. This is the only feature and content accessible to users who have not created a "User Account".

The Publisher reserves the right to restrict access to all or part of the application, temporarily or permanently, in particular for technical, legal, regulatory or security reasons.

B. REGISTRATION CONDITIONS

Registration with NOX is strictly personal and reserved for natural persons with the legal capacity to enter into a contract, or, failing that, a valid parental or legal authorization. Registration is forbidden to persons under the age of 15.

When creating their account, the User must provide accurate, complete and up-to-date information. Any attempt at identity theft, fraudulent registration, or deliberate provision of erroneous data may result in account deletion, without notice.

The Publisher reserves the right to refuse or suspend a registration in the event of a clear violation of these "Terms of Use", a history of abusive behavior on the platform, or suspicion of identity theft. In particular, the Publisher reserves the right to ban certain e-mail addresses, certain domain names, and certain telephone numbers from any new registration on NOX without notice or justification.

When registering, the User must provide the following information:

  • A secure password;

  • His date of birth;
  • His full name;
  • A unique username that will appear publicly in the App;

C. ACCOUNT CREATION AND IDENTIFICATION

Once the required information has been filled in and the contractual documents have been accepted, a personal account is created. The User will then be able to log in via their username (email address or telephone number) and password.

Each account is strictly personal. It is forbidden to share your credentials or allow the use of your account by a third party. The User is solely responsible for the use of his/her account, even in the event of unauthorized access resulting from his/her negligence.

D. ACCESS RESTRICTIONS AND ACCOUNT DELETION

The Publisher reserves the right to restrict access to the application or suspend an account in the following cases:

  • non-compliance with contractual documents, and in particular these "Terms of Use" or the "Code of Conduct";
  • publishing content categorized as "sensitive" without adding the "Sensitive Content" marking;
  • posting "Sensitive Content" in a posting format in which "Sensitive Content" is not tolerated;
  • posting "Prohibited Content";
  • inappropriate or abusive behavior towards other users;
  • breach of the security or integrity of the platform;
  • suspected fraud, technical circumvention or identity theft;
  • Prolonged account inactivity.

The Publisher may also proceed with the deletion of an account if it is found that the User does not comply with the minimum age requirements, or if there is a reasonable doubt about the accuracy of the information provided during registration.

No compensation may be demanded in this respect by the User, unless otherwise provided for by law.

5. ACCESS BY UNDERAGE USERS

Access to the "NOX – The Social Alarm Clock" application is subject to specific rules for minors. This section specifies the admission requirements, automatic safeguards, and restrictions and procedures put in place by the Publisher to ensure the safety of users under the age of 18.

The aim is to prevent any form of exposure to inappropriate or dangerous content, while ensuring a digital space that complies with legal requirements and good practices for the protection of minors.

A. MINIMUM AGE REQUIREMENT

The use of the app is strictly forbidden to persons under the age of 15. When registering, the User must enter his or her date of birth. In case of doubt about the declared age, the Publisher reserves the right to carry out verifications or to suspend access to the account concerned.

B. LACK OF BUILT-IN PARENTAL CONTROLS

The app does not offer an internal parental control device. The Minor User, if he/she meets the minimum age requirement, remains solely responsible for the use he/she makes of the application, under the possible supervision of his/her legal representative.

The Publisher encourages parents or guardians to interact with minors using the application and to monitor their online activity, particularly regarding the publication of content or interactions with other users.

C. SENSITIVE CONTENT AND AUTOMATIC RESTRICTIONS

Any account that is reported to belong to a user under the age of 18 is automatically subject to the following restrictions:

  • The "Hide sensitive content" setting is enabled by default;
  • Without the possibility of manual deactivation by the User concerned;
  • Content marked as "Sensitive Content" is automatically hidden, whether public or private.

These measures apply without the possibility of technical circumvention by the user.

D. PRIORITY MODERATION OF REPORTS INVOLVING MINORS

Reports relating to content or behaviour that potentially endanger minors are subject to priority processing by the Publisher's moderation team.

The following reporting objects are expressly provided for this purpose:

  • Child abuse;
  • Sexualization of children;

It also specifies the responsibilities of the User and the rights of the Publisher in terms of account management, including in the event of abusive behavior or violation of these "Terms of Use".

A. ACCOUNT CREATION AND UNIQUENESS

Each User undertakes to create and use only one personal account. The holding of several accounts by the same person, unless expressly authorized by the Publisher, is prohibited and may result in the suspension or deletion of all the accounts concerned.

B. CREDENTIALS, PRIVACY AND SECURITY

When creating their account, the User chooses a secure password, associated with a valid email address or mobile phone number.

These identifiers are strictly personal and confidential. The User is solely responsible for the conservation and security of his means of authentication. Any login or action taken through their account is deemed to have been performed by them, unless proven otherwise.

C. UPDATING INFORMATION

The User undertakes to keep the information related to his account up to date, in particular his contact details and his date of birth.

In the event of a change or error, it is up to the user to correct them via the application's dedicated interface. Inaccurate, incomplete, or misleading information may result in account limitation, suspension, or deletion by the Publisher.

D. VOLUNTARY DELETION OF ACCOUNT

The User can delete his account at any time, directly from the app's settings.

Removal will result in immediate deactivation of the account and loss of access to all associated content, interactions, settings, and services. It is definitive and irreversible.

The Publisher cannot be held responsible for the voluntary deletion of an account or the resulting loss of data.

E. REMOVAL OR SUSPENSION BY THE PUBLISHER

The Publisher reserves the right to temporarily suspend or permanently delete an account in the following cases:

  • non-compliance with the "Terms of Use" or the associated contractual documents;
  • posting prohibited, abusive, or harmful content;
  • disruptive or harmful behavior toward other users;
  • fraud, identity theft or unauthorized multiple use;
  • Threat to the security, integrity, or proper functioning of the Platform.

Depending on the seriousness of the facts, the Publisher may proceed with a temporary suspension or deletion without prior warning. In the most serious cases, a report may be made to the competent authorities.

7. GENERAL OBLIGATIONS OF USERS

The use of "NOX – The Social Alarm Clock" implies on the part of each User a responsible attitude, respectful of the other members of the community, of the laws in force and of the rules established by the Publisher. This section specifies the fundamental commitments that all Users must respect, whether they are an author, a spectator or simply registered on the application.

These obligations apply to all uses of the application, whether it is browsing, publishing content, participating in interactions or configuring one's profile.

The User has the duty to alert the Publisher in the event of observation of content that is manifestly illegal, shocking, dangerous or contrary to these "Terms of Use".

A built-in reporting system allows for early moderation alerts. The User may also write to report@nox.app in the event of an urgent or serious situation.

Any misuse repeated or misuse of the reporting system – in contradiction with the spirit of the "Code of Conduct" – may be subject to sanctions.

F. ACCOUNT SECURITY AND ACCOUNTABILITY

The User is responsible for the confidentiality and security of his account. It undertakes to:

  • use a strong password,
  • not share their login details,
  • Report any suspicious or unauthorized activity to help@nox.app.

Any negligence that compromises the security of the account may incur the liability of the User, including if the account is used by a third party for illicit or abusive purposes.

8. FEATURES OFFERED BY THE APP

The Application provides Users with a set of features designed to allow them to consult, create and interact with social content, in a personal or collective context.

This section describes the main features currently available in the App. This list is indicative and not exhaustive: some secondary, experimental or specific features for certain User profiles may not be included.

The Publisher also reserves the right to change the functionalities of the Application at any time, both in their form and in their content, without prior notification, in compliance with these "Terms of Use":

A. LOGIN AND REGISTRATION

  • Unregistered/non-connected video stream :
    Functionality allowing any Visitor to access a limited selection of public "noxs", without requiring registration or login;
  • Register with an email address :
    Functionality allowing the User to create a personal account by entering an email address and password;
  • Register with a mobile number :
    Functionality allowing the User to create a personal account by entering a mobile phone number and password;
  • Register with Google :
    Functionality that allows the User to create a personal account via their Google ID, with the transfer of essential authentication information;
  • Registering with Facebook :
    Functionality that allows the User to create a personal account via their Facebook ID, with the transfer of essential authentication information;
  • Register with Apple Sign In :
    Functionality that allows the User to create a personal account via the Apple Sign In service, under the conditions provided by Apple;
  • Login with an email address :
    Functionality that allows the User who is already registered to log in to his account by entering his email address and password;
  • Connection with a mobile number :
    Functionality allowing the User who is already registered to log in to his account by entering his phone number and password;
  • Connection with Google :
    Functionality allowing the User to log in to their account via their Google ID;
  • Connection with Facebook :
    Functionality allowing the User to log in to their account via their Facebook ID;
  • Login with Apple Sign In :
    Functionality that allows the User to log in to their account via the Apple Sign In service.

B. ALARM CLOCKS, ALARMS AND NOXS

  • Creation of an alarm :
    Functionality allowing the User to create an alarm in order to be woken up at a specific time according to his preferences;
  • Setting an alarm :
    Functionality that allows the User to configure the options associated with an alarm, including the time, days of repetition, sound volume, or customization options;
  • Activation of an alarm :
    Functionality allowing the User to activate a previously created alarm, with a view to its effective triggering at the defined time;
  • Receive a "nox" :
    Functionality allowing the User to receive public or private "noxs" with which he can wake up by selecting them for his alarm clock;
  • Select a "nox" for their alarm clock :
    Feature allowing the User to manually choose a specific "nox" that will be broadcast when their alarm is triggered;
  • Waking up with a "nox" :
    Functionality that allows the User to start their day by reading or listening to a "nox", which is automatically triggered by the alarm;
  • Send a message to the creator of a "nox" :
    Feature allowing the User to privately contact the author of a "nox" directly from the alarm clock triggering screen;

C. VIDEO STREAM, PLAYBACK, AND SOCIAL INTERACTIONS AROUND NOXS

  • Connected Video Stream :
    Functionality that allows the Connected User to access a feed enriched with "noxs", including recent, popular, suggested or personalized content based on their interactions;
  • Read a "nox" :
    Functionality that allows the User to open a "nox" in order to consult its textual, visual or audio content;
  • "Renox" a "nox" :
    Functionality allowing the User to republish a public "nox" on their own profile, with or without personal comment;
  • Like a "nox" :
    Functionality allowing the User to express their appreciation of a "nox" by assigning it a "like";
  • Add a "nox" to favorites :
    Functionality allowing the User to save a "nox" in his personal list of favorites, accessible at any time from his account;
  • Comment on a "nox" :
    Functionality allowing the User to publish a publicly visible comment under a "nox", under the conditions provided for by the Application;
  • Send a "nox" per message :
    Functionality allowing the User to share a "nox" with one or more recipients via the integrated private messaging;
  • Access the information of a "nox" :
    Functionality allowing the User to access the metadata related to a "nox" (date of publication, creator, number of views, type of content, etc.).

D. CREATION, MANAGEMENT AND ARCHIVING OF NOXS

  • Create a public "nox" :
    Functionality allowing the User to publish a "nox" visible to all Users and Visitors, according to the moderation rules in force;
  • Create a private "nox" :
    Functionality allowing the User to publish a "nox" visible only to himself and the recipients of the "nox", according to the moderation rules in force;
  • Create a sponsored "nox" :
    Functionality allowing the User to publish a "nox" marked as sponsored, as part of paid or partnered content, in accordance with the Advertising and Sponsored Content Policy;
  • Create a sensitive "nox" :
    Functionality allowing the User to indicate that a "nox" potentially contains "Sensitive Content", which limits its display depending on the parameters of the Application and the age of the User;
  • Access new "noxs" :
    Feature allowing the User to consult the last "noxs" they received, and with which they have not yet woken up;
  • Access the "noxs" received :
    Functionality allowing the User to access the history of the "noxs" received via the alarm, whether they have been assigned automatically or chosen manually;
  • Access the "noxs" created :
    Functionality allowing the User to consult the list of his own published "noxs", whether public or private;
  • Archive a created "nox" :
    Functionality allowing the User to remove a "nox" from their public display while keeping it in their personal archives;
  • Access "noxs" favorites :
    Feature allowing the User to find the "noxs" that he has saved as favorites;
  • Access the world map of users who have activated their alarm clock :
    Functionality that allows the User to view, on a map, the general and anonymized location of other Users who have activated their alarm, according to the defined privacy rules.

E. DREAMS AND DREAM COLLECTIONS

  • Read a "dream" :
    Functionality allowing the User to consult the content of a published "dream", depending on its visibility (public or private);
  • Like a "dream" :
    A feature that allows the User to assign a "like" to a "dream" that he or she has enjoyed;
  • Send a "dream" by message :
    Functionality allowing the User to share a "dream" with one or more other Users via private messaging;
  • Send a message to the creator of a "dream" :
    Functionality allowing the User to contact the author of a "dream" directly from the "dream" reader;
  • Create a public "dream" :
    Functionality allowing the User to publish a "dream" visible to all Users of the Application;
  • Create a private "dream" :
    Functionality allowing the User to create a "dream" visible only to himself and the recipients of the "dream";
  • Create a sponsored "dream" :
    Functionality that allows the User to post a "dream" marked as sponsored, as part of a partnership or paid content, in accordance with the "Advertising and Sponsored Content Policy";
  • Create a sensitive "dream" :
    Functionality that allows the User to post a "dream" potentially containing "Sensitive Content", which results in a display restriction according to the internal rules of the Application and the age of the User;
  • Create a "dream" collection :
    Functionality allowing the User to group several "dreams" in a thematic collection present on the profile;
  • Edit a "Dream" Collection :
    Functionality that allows the User to edit an existing "Dream" collection, including its title and the selection of "Dreams" it contains;

F. USER PROFILES AND ACCOUNT PERSONALIZATION

  • Visiting a User Profile :
    Functionality that allows the User to access another User's public page, including their accessible content, interactions and visible profile information;
  • Subscribe to a profile :
    Functionality that allows a User to follow the activity of another User in order to receive public content in his or her feed;
  • Change their profile picture :
    Feature that allows the User to update the image associated with their account and visible on their profile;
  • Modify their cover photo :
    Feature that allows the User to customize the header image displayed on their public profile;
  • Modify the description of his profile :
    Feature allowing the User to write or modify the textual description of his publicly visible profile;
  • Manage the list of "noxs" created from their profile :
    Functionality allowing the User to consult, archive or delete the "noxs" that they have published on their profile;
  • Manage the list of "renoxs" in their profile :
    Functionality allowing the User to access the content they have republished via the "renox" feature, and to manage them;
  • Manage the "dream" collections of their profile Functionality allowing the User to access the "dream" collections they have created, modify their content or delete them;

G. SEARCH AND PRIVATE MESSAGING

  • Search for a user :
    Functionality that allows the User to search for another User based on their name, unique username, or other available identification criteria;
  • Search for a "nox" :
    Functionality allowing the User to search for a "nox" using text, keywords, or thematic filters;
  • Access the list of conversations :
    Functionality allowing the User to consult all of his private chats with other Users;
  • Delete a conversation :
    A feature that allows the User to remove a conversation from their personal messaging interface. Deletion does not affect messages that are visible to other parties in the conversation;
  • Send a text message :
    Functionality that allows the User to send a written message to one or more other Users, via private messaging;
  • Send a photo :
    Functionality that allows the User to share an image in a private conversation, subject to the accepted formats;
  • Send a video :
    Functionality allowing the User to share a video file in a private conversation, within the limits defined by the Application;
  • Send an audio message :
    A feature that allows the User to record and then send a voice message as part of a private conversation;
  • Send GIF :
    A feature that allows the User to select and send an animated GIF file in a private conversation, from an embedded or external library.

H. ACCOUNT SETTINGS AND PERSONALIZATION OF THE EXPERIENCE

  • Change their name :
    Functionality that allows the User to change the name associated with their account, visible on their public profile;
  • Modify their unique username :
    Functionality that allows the User to change their unique public identifier (username), used in particular for social interactions and search;
  • Change your login ID :
    Functionality allowing the User to change the email address or phone number used to log in to the Application;
  • Change password :
    Functionality allowing the User to change their login password, at any time, via the security settings of their account;
  • Manage notifications :
    Functionality that allows the User to enable or disable push or internal notifications, depending on the events they wish to track (subscriptions, comments, alarm clocks, etc.);
  • Access the history of "noxs" liked :
    Feature allowing the User to consult all the "noxs" they have liked since the creation of their account;
  • Access the history of "noxs" viewed :
    Functionality allowing the User to access the list of "noxs" that they have read, listened to or seen, from their account;
  • Access the archive of created dreams :
    Functionality allowing the User to consult the dreams that have been automatically archived, whether public or private;
  • Access the archive of "noxs" created :
    Functionality allowing the User to consult his archived "noxs", withdrawn from public publication but kept in his personal space;
  • Access the user manual :
    Functionality that allows the User to consult a user guide for the Application, describing the main functions and advice for use;
  • Access to legal information :
    Functionality allowing the User to access the contractual documents of the Application;
  • Manage consent preferences :
    Functionality that allows the User to configure their preferences relating to the collection and processing of their personal data at any time, in accordance with the GDPR;
  • Manage their privacy settings :
    Functionality allowing the User to define the visibility of their profile, their content, and the interactions allowed with other Users;
  • Manage the display of "Sensitive Content" :
    Functionality that allows the User of legal age to choose whether to see or hide content marked as "Sensitive Content". This option is disabled by default for Underage Users;
  • Manage blocked users :
    Functionality allowing the User to consult and modify the list of Users they have blocked, in order to restrict interactions;
  • Contact Support :
    Functionality allowing the User to request assistance from the Application team in the event of a technical difficulty or question related to the use of the service;
  • Obtain certification :
    Functionality allowing the User to request the certification of his account, according to the criteria defined by the Publisher;
  • Receiving personal data :
    Functionality allowing the User to exercise their right of access by receiving a copy of the personal data that the Application holds about them;
  • Change the language of the Application :
    Functionality allowing the User to choose the language in which the Application is displayed from the available options;
  • Modify the appearance of the application :
    Functionality that allows the User to customize the appearance of the application's interface (light mode, dark mode, text size, etc.).

I. NOX PREMIUM, SOCIAL MEDIA AND ACCOUNT CLOSURE

  • Subscribe to "NOX Premium" :
    Functionality that allows the User to subscribe to the "NOX Premium" subscription via in-app purchase, to benefit from additional services such as the removal of unsolicited advertisements, as well as additional features;
  • Unsubscribing from "NOX Premium" :
    Functionality allowing the User to cancel their "NOX Premium" subscription via the Application's settings or directly from the payment platform (App Store or Play Store), with effect from the end of the current period;
  • Access the social networks of LAPSUS and NOX :
    Functionality allowing the User to access the official pages of the Publisher and the Application on third-party platforms (Instagram, TikTok, LinkedIn, etc.), from the interface of the Application;
  • Delete their account :
    Functionality allowing the User to permanently close their personal account, resulting in the deletion or anonymization of their personal data, in accordance with the applicable regulations.

9. USE OF THE APP AND FEATURES

The "NOX – The Social Alarm Clock" application offers its users a space for expression and sharing structured around specific features. This section specifies the general rules for the use of the application, the limits of authorized use, and the principles applicable to the operation of its features.

It reminds that any use of the application must be carried out in compliance with these "Terms of Use", the laws in force, and the principles defined in the "Code of Conduct".

A. GENERAL RULES OF USE

The User undertakes to use the application in a fair, honest manner, respectful of its social purposes and of other users.

It is prohibited from misusing the functionalities of the application for the purposes of:

  • prospecting or harassment;
  • mass manipulation or dissemination of disinformation;
  • commercial or political exploitation without the express authorisation of the Publisher;
  • endangering others or oneself.

The use of the application is subject to compliance with the technical, contractual and community limitations set out in these "Terms of Use".

B. PERSONAL AND NON-COMMERCIAL USE

The "NOX – The Social Alarm Clock" application is intended for mainly personal, non-commercial and non-professional use. However, the Publisher authorises the publication of "Sponsored Content", provided that it is clearly identified as such and complies with the rules set out in the "Advertising and Sponsored Content Policy".

The User undertakes not to divert the application from its social purposes to make it a disguised advertising channel or a medium for abusive prospecting.

In particular, the following are prohibited:

  • the sale or resale of access to the application or personal content;
  • using accounts to deliver promotional messages that are not marked as such;
  • automating interactions for visibility or commercial amplification.
  • the use of fraudulent methods to increase the exposure of "Sponsored Content".

"Sponsored Content" must be marked as such when it is published, via the system provided for this purpose. The User remains solely responsible for the legality, transparency and compliance of its sponsorship activities.

In the event of a breach, the Publisher reserves the right to limit, suspend or remove access to the sponsored publication features, or even to deactivate the account concerned.

C. LIMITATIONS AND TECHNICAL CONDITIONS OF USE

The User is informed that certain functionalities may be restricted depending on:

  • the age declared in their profile (e.g. "Sensitive Content", visibility settings);
  • the technical configuration of its terminal;
  • the quality of its Internet connection;
  • The version of the app installed.

The Publisher reserves the right to modify, disable or limit certain features:

  • for security, maintenance or updating reasons;
  • to evolve the user experience;
  • to meet legal or regulatory requirements.

No guarantee is provided as to the permanent availability of each feature, which may be temporarily or permanently suspended at the initiative of the Publisher, without compensation.

10. USER-CREATED AND SHARED CONTENT

"NOX – The Social Alarm Clock" is based on the free and spontaneous publication of content by its users, in different forms ("noxs", "dreams", texts, sounds, images, videos, reactions, etc.). This section specifies the policies and responsibilities that apply to content created, published, or shared within the app.

It distinguishes between the types of content authorized, the obligations of users, the applicable legal regime and the limits imposed by the Publisher to guarantee a safe, respectful environment that complies with the laws in force.

A. TYPES OF CONTENT CONCERNED

The content created, shared or exchanged by users via the "NOX – The Social Alarm Clock" application may fall under several distinct legal statuses. A distinction is made between "Classic Content", "Sponsored Content", "Sensitive Content" and "Prohibited Content":

  • "Classic Content" refers to all content that is not sponsored, sensitive or prohibited. They may be public or private, and remain subject to these "Terms of Use" as well as the "Code of Conduct";
  • "Sponsored Content" is content published as part of a commercial relationship, promotional relationship or partnership. Their publication is authorized subject to explicit marking at the time of publication, in accordance with the "Advertising and Sponsored Content Policy". Any concealment of the sponsored nature is prohibited;
  • "Sensitive Content" refers to content that may offend the sensibilities of certain users due to its explicit, disturbing or emotionally strong nature. They must be marked as such at the time of publication. Their access is automatically restricted for underage users. "Sensitive Content" must not fall under any circumstances as "Prohibited Content";
  • "Prohibited Content" is that the publication of which is strictly prohibited, including in a private setting. They are defined in the "List of Prohibited Content", available at the following address: https://www.nox.app/legal/illegal-content. Their dissemination leads to penalties that can go as far as deleting the account or reporting it to the competent authorities.

These rules apply in particular, regardless of their status or purpose, to the following formats:

  • "noxs" (videos of a maximum duration of two minutes, public or private);
  • the miniatures of "noxs" (cover images);
  • "dreams" (ephemeral photos or videos visible for 24 hours);
  • titles of "dream" collections;
  • the miniatures of "dream" collections (cover images);
  • profile pictures;
  • Cover photos (up to ten per user)
  • Textual profile descriptions.
  • comments;
  • private messages, including: text messages, voice messages, photos, videos, GIFs;
  • any file or information made available via the application, whether distributed by a user, the Publisher or a third party, subject to compliance with applicable law.

B. USER RESPONSIBILITIES

Each User is fully responsible for the content that he or she creates, publishes, shares or exchanges via the application, regardless of its status ("Classic Content", "Sponsored Content", "Sensitive Content" or other) and regardless of its format (public, private, ephemeral or persistent).

It is the responsibility of the employer to ensure that:

  • the content does not contravene these "Terms of Use" or the "Code of Conduct";
  • the content is not listed in the "List of Prohibited Content";
  • it complies with the laws and regulations in force, in particular with regard to defamation, hatred, harassment, protection of minors, privacy and intellectual property;
  • the specific markings are correctly applied ("Sensitive Content", "Sponsored Content", etc.).

The Publisher cannot be held responsible for the content published by users, but reserves the right to moderate, hide, reclassify, delete or report it at any time, in accordance with the "Moderation Policy".

C. OWNERSHIP AND LICENSE TO USE

The User remains the owner of the intellectual property rights on the content that he or she publishes on the application, in compliance with the rights of third parties.

By publishing content on "NOX – The Social Alarm Clock", the User grants the Publisher a non-exclusive, free, worldwide, transferable and sub-licensable license, allowing it:

  • host, store, index, reproduce, adapt, distribute and transmit the content within the application;
  • Leverage it in all areas of the app, including public feeds, algorithmic suggestions, search results, editorial collections, archives, contextual formats, or temporary or permanent highlight areas.
  • integrate it into the application's internal communication media (presentations, tutorials, trend summaries, thematic highlights, etc.);
  • to use it for commercial or advertising purposes, free of charge, in the communication and promotion of the application, including on external media (social networks, awareness campaigns, demonstrations, presentations to third parties), provided that:
    • the content is public at the time of use;
    • the identity of the author is not distorted;
    • no "Sensitive" or controversial content is used without prior consent.

This license remains valid for the duration of the content being posted on the platform. It ends automatically when the content is removed, unless blocked for security, procedural or legal reasons. The User may at any time request the removal of reused content, upon simple request to legal@nox.app.

D. PROHIBITION OF CERTAIN CONTENT

It is strictly forbidden to publish, share, disseminate or transmit, including by private message, content falling within the prohibited categories defined in the "List of Prohibited Content", whether textual, visual, audio, implicit or explicit.

The private, temporary or confidential nature of content does not in any way exempt it from this prohibition.

The publication of "Prohibited Content" constitutes a serious breach of these "Terms of Use". It can lead to:

  • the permanent and irretrievable removal of the content concerned;
  • the temporary suspension of the User Account;
  • the permanent deletion of the User Account, without returning the content or refunding any paid services subscribed to;
  • the banning of the User from the Application, prohibiting him from accessing the service again in the future;
  • the reporting of the User to the competent authorities if the situation so requires.

The Publisher applies a zero-tolerance policy towards content that endangers people, in particular minors.

11. REPORTING, MODERATION AND PENALTIES

The Publisher of "NOX – The Social Alarm Clock" ensures uninterrupted human moderation of the content published on the application, in order to guarantee security, compliance with contractual rules and compliance with the laws in force. This section specifies the reporting mechanisms available to users, the principles of moderation applied, and the sanctions that may be implemented in the event of non-compliance with these "Terms of Use".

Moderation applies to both public and private content, as long as it contravenes the established rules, and within the limits of the human processing capacities put in place.

A. INTEGRATED REPORTING SYSTEM

Any user may report content, behaviour or an account that is contrary to these "Terms of Use", the "Code of Good Conduct", the "List of Prohibited Content" or the law.

Each content published or shared in the Application can be reported from an option accessible in the immediate vicinity of this content (icon or dedicated menu). This procedure applies to all of the following content:

  • "nox";
  • "dream";
  • title of a collection of "dreams";
  • "dreams" collection miniature;
  • comment;
  • profile picture;
  • cover photo;
  • Profile text description;
  • text, voice, photo or GIF message in the messenger.

When reporting, the User is invited to select one of the 15 objects below:

  • Spam or scam
  • Prohibited sales
  • Copyright Infringement
  • Identity theft
  • Disinformation and false information
  • Pornography or sexually explicit content
  • Hate speech
  • Privacy breach
  • Harassment or threats
  • Incitement to terrorism
  • Violence or dangerous behaviour
  • Child Endangerment
  • Child abuse
  • Sexualization of children
  • Child exploitation or abuse

This way of reporting content is the main way and recommended by the Publisher to the Users of the Application.

B. HUMANE AND PROACTIVE MODERATION

The content and Users of the "NOX – The Social Alarm Clock" Application are moderated by the Publisher's internal moderation team. No subcontracting or outsourcing is carried out. The entire process is placed under the exclusive responsibility of the Publisher, who ensures its management, supervision and traceability.

The moderation infrastructure includes:

  • a system of regular monitoring of content published in public and semi-public spaces;
  • restricted, secure, and tracked access to administrative tools.
  • a dedicated team, trained in the contractual and legal criteria applicable to moderation;
  • an internal protocol for handling reports, escalating sensitive cases and making decisions;
  • a system for recording decisions and actions taken for internal control purposes.

This infrastructure guarantees the independence, consistency and responsiveness of moderation operations, in compliance with the commitments made by the Publisher to Users.

Moderation is carried out using tools developed internally by the Publisher, specifically designed to meet the contractual, legal and technical requirements of "NOX – The Social Alarm Clock". These tools allow for detailed management of reports, follow-up of decisions taken, complete traceability of moderation actions, as well as secure, logged access reserved for authorized members of the moderation team.

To ensure continuous and responsive coverage, moderation is provided 24/7 from three main locations: Bourg-en-Bresse in France, Montreal in Canada and Ho Chi Minh City in Vietnam. This international organization makes it possible to process content in real time, to prioritize certain sensitive reports (especially those involving minors or emergency situations), and to ensure continuity of service.

The moderation team is made up of professionals trained in the applicable contractual, legal and ethical criteria, and acts according to strict internal procedures governing the evaluation of content, decision-making, notification of measures and retention of supporting elements.

C. PRIORITIZATION OF REPORTS RELATING TO MINORS

The protection of minors is an absolute priority for the Publisher. As such, any alert or report relating to content or behaviour likely to endanger a minor is subject to reinforced and priority processing by the moderation team.

The following reporting objects are expressly provided for this purpose in the dedicated interface:

  • Endangerment of children (incitement to risky behaviour, threats, serious negligence);
  • Child abuse (physical, verbal or psychological violence, humiliation);
  • Sexualization of children (inappropriate suggestions, sexual comments, dissemination of sexualized images of minors, even clothed);
  • Exploitation or abuse of children (grooming, handling, sending or requesting inappropriate content, attempting to contact or control).

Any such report is immediately reviewed by the human moderation team, with no guaranteed delay but with a higher level of priority than any other processing.

When a report is deemed credible or sufficiently worrying, the Publisher reserves the right to take the following measures without notice:

  • Immediate removal of the affected content;
  • Temporary blocking or permanent deletion of the account of the author of the offending content or behavior;
  • Reporting to the competent authorities (in particular in application of the French Criminal Code, European legislation on child protection, or on judicial request).

The Publisher applies a zero-tolerance policy towards behaviour or content that calls into question the integrity, dignity or safety of minors. Any attempt to technically or declaratively circumvent the restrictions applicable to underage users may also result in account deletion measures and external reporting.

The moderation team is trained to identify these situations and reserves the right to intervene even in the absence of a report, when suspicious content is detected as part of a proactive check.

D. NOTIFICATION OF DECISIONS

The User whose content or account has been the subject of a moderation decision is in principle notified within a reasonable period of time.

This notification may take the form of:

  • an in-app message;
  • an email to the address linked to the account;

No detailed justification is required. In the event of particularly serious, threatening or illegal behaviour, no prior notification is required.

No appeal is provided for against the decisions of moderation, unless otherwise provided for by law.

12. INTELLECTUAL PROPERTY

This section specifies the rules applicable to the intellectual property rights relating to the application "NOX – The Social Alarm Clock", both on the side of the Publisher and the Users. It defines the rights granted by Users when publishing content, as well as the limitations imposed on the use of protected elements belonging to the Publisher or to third parties.

NOX takes a permissive but controlled approach to the creation, sharing and reuse of content, in compliance with copyright, the law and digital best practices.

A. RIGHTS OF THE PUBLISHER

All the elements that make up the "NOX – The Social Alarm Clock" application (architecture, design, logo, name, interface, databases, algorithms, texts, images, sounds, videos, features, documentation, etc.) are protected by intellectual property rights (copyright, trademark law, sui generis right of databases, etc.).

These elements are the exclusive property of the Publisher or are subject to user licenses regularly acquired from third parties.

Any unauthorised reproduction, representation, distribution, modification, extraction, imitation or exploitation of one or more protected elements is strictly prohibited and may result in civil and/or criminal proceedings, in accordance with the Intellectual Property Code and the international conventions in force.

B. USER-CREATED AND PUBLISHED CONTENT

Users retain all intellectual property rights attached to the content they publish on the application, within the limits of the licenses granted to the Publisher for the technical and functional operation of the services.

Each User guarantees:

  • that it holds the necessary rights to publish the content in question;
  • that the content does not infringe the rights of third parties (in particular copyright, image rights, trademarks, secrets, databases);
  • that it does not include excerpts from protected works without express authorization, except in cases of quotation, parody or exception provided for by law.

In the event of doubt as to the legality of content, the Publisher reserves the right to hide or delete it as a precautionary measure, without prejudice to the other measures provided for in these "Terms of Use".

C. USERS' RESPONSIBILITY FOR CONTENT

Each User is solely responsible for the content they publish, including their compliance with intellectual property law. They undertake not to reproduce, adapt, distribute or exploit content for which they do not hold the rights, or which they do not have the right to use as part of the application.

The User acknowledges that:

  • any fraudulent or abusive use of protected content is subject to liability;
  • any infringement of the rights of a third party may result in the removal of the content and contractual sanctions;
  • any claim relating to copyright infringement may give rise to a request for removal, investigated by the Publisher according to the procedure defined in the "Copyright and Intellectual Property Policy".

The Publisher declines all responsibility in the event of infringement of intellectual property rights by a User, but undertakes to cooperate with the legitimate rights holders within an appropriate legal framework.

13. RESPONSIBILITY OF THE PUBLISHER

The Publisher of "NOX – The Social Alarm Clock" strives to offer a functional, secure application that complies with the legal obligations in force. However, as a technical intermediary and host of user-generated content, its liability regime is governed by law. This section specifies the limits of the Publisher's liability regarding access to the application, the content published by users, and any damages suffered in connection with the use of the platform.

A. AVAILABILITY AND ACCESS TO THE APPLICATION

The Publisher implements all reasonable means to ensure continuous, stable and secure access to the application. However, access may be temporarily suspended, limited, or terminated without notice, including:

  • for technical reasons (maintenance, updating, breakdown, overload);
  • for security or anti-abuse reasons;
  • to comply with legal or regulatory obligations.

The Publisher cannot be held responsible for any interruptions, unavailability or degradation of service, nor for the consequences that may result for the user, except in the case of gross negligence or proven negligence.

No guarantee of uninterrupted or error-free operation is given, and access to the App is provided "as is".

B. CONTENT POSTED BY USERS

"NOX – The Social Alarm Clock" is based on user-generated content. As such, the Publisher acts as a host within the meaning of Article 6 of the Law for Confidence in the Digital Economy (LCEN) and the Digital Services Act (DSA).

The Publisher is not the originator of the content published by users, and cannot guarantee its veracity, legality or relevance, except when it acts as the author or direct publisher of specific content.

The Publisher has set up a human moderation system as well as a reporting system accessible to all users. It undertakes to promptly remove any manifestly illegal content as soon as it becomes aware of it, in accordance with the rules in force and the "Illicit Content Reporting and Removal Policy".

The Publisher cannot be held liable for damages resulting from content published by third-party users, except in the event of wrongful inaction after regular notification.

C. LIABILITY FOR DAMAGE

The Publisher cannot be held liable for any direct or indirect, material or immaterial damage suffered by the user in the context of the use of the application, except in the event of proven fault on its part. This includes:

  • loss of data or content;
  • loss of opportunity, use or exploitation;
  • attacks on image, reputation or privacy related to the use of the platform by third parties.

The Publisher also declines all liability in the event of:

  • improper use of the application by the user or a third party;
  • negligence of the user in the management of his account or its contents;
  • unauthorized access to an account due to a compromised password.

The Publisher reserves the right to modify, suspend or delete all or part of the application, without this giving rise to the right to compensation.

14. PROTECTION OF PERSONAL DATA AND PRIVACY

"NOX – The Social Alarm Clock" attaches fundamental importance to the confidentiality, security and respect of its users' personal data. This section recalls the basic principles applicable to the collection, processing, security and rights of users, without replacing the complete contractual documents that are the "Privacy Policy" and the "Data Collection Policy", accessible at any time from the application and at the address: https://www.nox.app/legal.

A. DATA COLLECTION AND PROCESSING

When using the application, the Publisher is required to collect and process certain personal data, in particular when:

  • the creation of an account (identifiers, age, contact details, preferences);
  • the use of features (published content, interactions, technical logs);
  • navigation (statistics, logs, technical information not directly identifying).

The main purpose of the processing carried out is to:

  • the operation and improvement of the application;
  • Personalization of the user experience (feed, suggestions, language, display);
  • security, anti-abuse, and legal compliance.

The processing is carried out on the basis of consent, contractual performance or compliance with legal obligations, as the case may be.

B. CONSENT AND PREFERENCES

When using the application, the Publisher is required to collect and process certain personal data, in particular when:

  • the creation of an account (identifiers, age, contact details, preferences);
  • the use of features (published content, interactions, technical logs);
  • navigation (statistics, logs, technical information not directly identifying).

The main purpose of the processing carried out is to:

  • the operation and improvement of the application;

The Publisher implements appropriate technical and organizational measures to protect user data against loss, unauthorized access, alteration, disclosure or destruction.

This includes:

  • encryption of stored and transmitted data;
  • Strict access restrictions within internal teams.
  • regular security checks and incident management procedures.

Access to the data is strictly limited to authorised persons, within the framework of specific and legitimate missions. No personal data is sold, exchanged or transferred to unauthorized third parties.

D. USER RIGHTS

In accordance with the General Data Protection Regulation (GDPR), all Users have the following rights:

  • right of access to their personal data;
  • right to rectification in the event of an error or update;
  • right to erasure ("right to be forgotten");
  • the right to restriction or objection to processing in certain cases;
  • right to the portability of data provided voluntarily.

These rights can be exercised at any time, without justification, by contacting the dedicated service at the address: privacy@nox.app
A response will be provided within a maximum period of 30 days, except in exceptional situations requiring a justified extension.

15. MODIFICATION OF THE APPLICATION OR GENERAL CONDITIONS OF USE

The "NOX – The Social Alarm Clock" application is expected to evolve regularly, both functionally and legally. This section specifies the terms and conditions for modifying the application, updating these "Terms of Use", and the rights of the User in the event of disagreement.

The Publisher reserves the right to adapt the operation of the application and the contractual content that governs it, in compliance with the applicable rules and transparency with regard to its users.

A. APPLICATION EVALUATION

The Publisher may at any time develop the application, its interfaces, its functionalities, its formats or its architecture, in particular to:

  • improve the user experience;
  • integrating new uses;
  • ensure security or legal compliance;
  • correct malfunctions or technical vulnerabilities.

These changes may be accompanied by imposed technical updates, via the official stores (App Store, Play Store). Some features may be changed, temporarily disabled, or removed without notice or compensation.

B. CHANGES TO THE TERMS AND CONDITIONS OF USE

The Publisher reserves the right to modify these "Terms of Use" at any time, in particular to:

  • take into account legal, regulatory or jurisprudential developments;
  • adapt the content to changes in the application;
  • specify, clarify or supplement certain clauses.

In the event of a substantial change, the User will be informed by any means deemed appropriate (in-app notification, email). The current version of the "Terms of Use" can be consulted at any time at the following address: https://www.nox.app/legal/terms-of-use.

C. REJECTION OF CHANGES

If the User does not accept the new version of the "Terms of Use", he/she must immediately stop using the application and, if applicable, delete his/her account from the settings.
Continued use of the application after the entry into force of the new "Terms of Use" implies full and complete acceptance of them.

No appeal may be lodged solely because of a modification of these "Terms of Use", provided that this is carried out under the conditions provided for in this article.

16. TERM, SUSPENSION AND TERMINATION OF THE TERMS AND CONDITIONS OF USE

These "Terms of Use" provide a legal framework for the relationship between the User and the Publisher throughout the duration of use of the "NOX – The Social Alarm Clock" application. This section specifies the duration of the applicability of the "Terms of Use", the cases of temporary suspension of the account, as well as the terms of termination at the initiative of either party.

A. COMING INTO FORCE AND DURATION

These "Terms of Use" come into force as soon as they are accepted by the User, materialized by the creation of an account or the active use of the application.

They remain in force as long as the User maintains an active account or accesses the application, unless modified or terminated early in accordance with the terms and conditions set out herein.

The User acknowledges that he/she is required to comply at all times with the current version of the "Terms of Use", which can be consulted at the address: https://www.nox.app/legal/terms-of-use.

B. ACCOUNT SUSPENSION

The Publisher reserves the right to temporarily or permanently, without notice, suspend all or part of the functionalities of a User's account in the event of:

  • suspicion of violation of these "Terms of Use", the "Code of Good Conduct" or an associated contractual document;
  • abusive, fraudulent or dangerous behaviour;
  • abnormal technical activity or potentially detrimental to the proper functioning of the application.

The suspension can be preventive or precautionary, while a check or report is processed. It does not give rise to any right to any compensation or compensation.

C. TERMINATION AT THE USER'S INITIATIVE

The User may terminate the contract with the Publisher at any time by deleting their account via the application's settings.

This deletion will result in the immediate deactivation of the account, the loss of access to the content, and the termination of all associated usage rights. It constitutes permanent termination of these "Terms of Use", without notice required.

No return of data, content or settings is guaranteed after deletion of the account.

D. TERMINATION AT THE PUBLISHER'S INITIATIVE

The Publisher may unilaterally terminate these "Terms of Use" against a User in the following cases:

  • serious or repeated breach of these "Terms of Use" or any associated contractual document;
  • posting prohibited content or endangering others;
  • well-founded report issued by a competent authority;
  • breach of the law or essential obligations of good faith.

Termination may occur without notice or notice, and may be accompanied by the immediate deletion of the account concerned. In the event of termination for misconduct, the User permanently loses access to the application and the content linked to his account.

17. APPLICABLE LAW AND JURISDICTION

These "Terms of Use" are governed, interpreted and applied in accordance with French law, subject to the application of the mandatory rules provided for by European Union law or by any other more protective local law applicable to the User in his country of residence.

In the event of a dispute relating to the interpretation, validity, execution or termination of these Terms and Conditions, or to the use of the Application, the competent courts shall be those within the jurisdiction of the Publisher's registered office, unless otherwise required by mandatory legal provision, in particular with regard to consumer protection.

The User is informed that, in accordance with Articles L.611-1 et seq. of the Consumer Code, he or she has the possibility of having recourse free of charge to a consumer mediator, with a view to the amicable resolution of any dispute that may arise between him or her and the Publisher.

Nothing herein shall limit the mandatory legal rights of the User under the applicable legislation in his country of residence.
